The Halara Circle Sweepstake Official Rules


ENTERING OR WINNING REQUIRES NO PURCHASE OR PAYMENT OF ANY KIND. WINNING CHANCE IS NOT INCREASED BY PURCHASING. SWEEPSTAKE BY CHANCE. VOID WHERE PROHIBITED.

ELIGIBILITY.

The Halara Circle Sweepstake ("Sweepstake”) is exclusively available to individuals who are the Sponsor's existing customers ( who have made a purchase and completed an order on halara.com or Halara’s official TT shop before the Entry Period) and special invitees aged 18 years (or otherwise legal age of majority required by your local laws) or older, legally residing in the United States, including Puerto Rico and the District of Columbia, with the exception of the State of New York and the State of Florida ("Entrant"). Any individuals who fall under the category of employees or directors of FULL SCALE FULL SPEED PTE. LTD. (hereinafter referred to as "Sponsor"), or any of its parents, subsidiaries, and affiliates, including advertising, promotion, or production agencies, along with their respective immediate family members and individuals living in the same household, collectively referred to as the "Sweepstake Entities," are not eligible to participate in this Sweepstake. Void where prohibited. All applicable federal, state, and local laws apply.

Prize Details

Prize: In this Sweepstake, we have three products available to choose from, Entrants can only choose one of the three products as their prize ("Product") upon entering the Sweepstake.
PRIZE/ Approximate Retail Value.: 5,000 pairs of leggings, each valued at $50, with a total value of $250,000
Entrants can choose their first and second preferred options of Product. If the first choice is unavailable, the selected winner will receive their second choice as per their selection during the entry period.

Participation Notice

Click on the landing page to enter up for the Sweepstake, select the product, and fill in your shipping information and email;
Winners selected in this Sweepstake will receive free prizes to try on the Product and will be asked to submit an honest feedback.
Winners are not required to make any payment to claim or receive their prize.
*If you are selected as a winner, you will be required to sign an Affidavit of Eligibility, and a Liability Release, (where legal) - we refer to these as the "Prize Claim Agreement”.
*If you fail to comply with our requests for Prize Claim Agreement, are found to be ineligible, or cannot or do not comply with these Official Rules, you will be disqualified, and the prize may be awarded to an alternate winner.

Sweepstake Event Process

  1. Eligibility: Entrant must first become a Halara member, meaning you must have made a purchase on the Halara website/APP/TikTok official store.
  2. Entry: Users can enter during Entry Period by filling out basic information and selecting products, then submitting the application to enter The Halara Circle.
  3. Winner Selection: by chance.
  4. Winner Notification: After the Sweepstake winners are announced, winners will be notified via email. Please keep an eye on your inbox.
  5. Product Shipment: We will send the prizes out within 3 working days after the winners are announced.
  6. Receiving & Trying On: Winners- After receiving your product, please try it on and fill out the fitting survey ("Survey") carefully. You can access the Survey by scanning the QR code on the card inside the package or via the link we send you by email.
  7. Data Collection & Analysis: After collecting the Surveys, we will conduct a detailed analysis and use the feedback to improve the product and address any issues raised.
  8. Product Launch: After refining and optimizing the product based on feedback, we will relaunch it, giving the Halara community the opportunity to try out the new and improved style.

RELEASE OF LIABILITY.
You agree that the Sweepstake( The Halara Circle ) shall not be responsible or liable for, and hereby release them from, any and all costs, injuries, losses, or damages of any kind, including, without limitation, death and bodily injury, arising, either directly or indirectly, from participation in the Sweepstake or any Sweepstake-related activity, or from the acceptance, receipt, possession, and/or use or misuse of any prize, and (b) have not provided any warranty, representation, or guarantee, express or implied, in fact or in law, regarding any prize, including, without limitation, its quality or fitness for a particular purpose.

By participating in the Sweepstake, you agree that any disputes, claims, and causes of action related to the Sweepstake or any prize awarded will be resolved individually, without resorting to any form of class action. You also agree that any claims, judgments, and awards will be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the Sweepstake, but you will not be entitled to recover attorney's fees, except for New Jersey residents. Furthermore, you waive all rights to claim punitive, incidental, indirect, or consequential damages and any other damages, other than reasonable and actual out-of-pocket expenses. These rules and any disputes relating to them are governed by the laws of the State of California, without regard to principles of conflicts of laws. By entering, you consent to the exclusive jurisdiction of the state and federal courts in California for resolution of any disputes relating to the Sweepstake and waive any objection to it.

LIMITATION OF LIABILITY AND Sweepstake OPERATION INTEGRITY.
No responsibility will be assumed for any damage to your computer system or mobile device that may occur as a result of participating in the Sweepstake. This includes computer system malfunctions, mobile device malfunctions, hardware malfunctions, software malfunctions, or Sweepstake malfunctions, as well as other errors, failures, or delays. Please note that we cannot accept responsibility for any incomplete, illegible, misdirected, misprinted, forged, tampered with, altered, late, lost, damaged, or stolen submissions, prize notifications, or any other Sweepstake materials; all of these will be considered void. Additionally, we cannot take responsibility for lost, interrupted, inaccessible, or unavailable networks, servers, satellites, Internet service providers, websites, or other connections, or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone, or cable transmissions. We cannot be held responsible for any technical malfunctions, failures, difficulties, or other errors of any kind or nature, or for the incorrect or inaccurate capture of information, or the failure to capture any information.
The Halara reserves the right to amend, extend, suspend, or terminate the Sweepstake, either in its entirety or partially, if it finds that the Sweepstake is technically impaired or corrupted, or if it suspects any fraudulent activity, technical problems, failures, malfunctions, or other unexpected circumstances that may have impeded the integrity, administration, security, proper play, and/or feasibility of the Sweepstake as envisaged herein. In the Sweepstakeevent that the Sweepstake is terminated before the scheduled end date, Halara will (if feasible) select a winner from all eligible, non-suspect entries that remain unaffected by the problem.

ENTRY CONTENT RESTRICTIONS.
Entry in the Sweepstake in no way authorizes Entrants to use the Sponsor’s Intellectual Property (“Halara IP”). Halara IP includes without limitation patents, copyrights, trade secrets, designs, trademarks (including service marks), trade dress and other similar intellectual property that may exist anywhere in the world, whether registered or unregistered, and all applications and registrations with respect to any of the foregoing. Entrants are prohibited from using any Halara IP in urls, on websites, or for any other use. All rights reserved.
Failure of any Entry to comply with the above Entry Requirements and Entry Content Restrictions, as determined by Sponsor, in its sole discretion, may result in disqualification of Entrant. Without limitation, Sponsor reserves the right in its sole discretion to disqualify any Entry that, in its sole opinion, refers, depicts or in any way reflects negatively upon the Sponsor, the Sweepstake or any other person or entity, does not comply with these Sweepstake Rules or if Sponsor receives notification about any potential infringements or breaches of law or any other reason set forth herein. Entries must be suitable for presentation in a public forum, in sole determination of Sponsor.

TAX RESPONSIBILITY.
As a United States resident, federal law requires a winner to pay income tax on any winnings valued at over $600 USD. The prize value is considered ‘income’ and must be reported on the winner’s tax return as taxable income. The winner is solely responsible for paying the tax, not the Halara. If you win a prize over $600, expect the Halara to request that you complete an IRS W9 form as a condition of acceptance of the prize. Furthermore, the Halara is required to issue you an IRS 1099-MISC form for the Fair Market Value of the prize.

MISCELLANEOUS.
By taking part in this Sweepstake, you agree to abide by these Official Rules, including all eligibility criteria, and accept the decisions of the judges, which are final and binding in all matters relating to the Sweepstake.
It is of utmost importance that all the Official Rules are followed in order to be eligible for the Sweepstake. Any entry materials that have been tampered with or altered will not be accepted. It is worth noting that Sponsor shall not be held responsible for lost, incomplete, damaged, or illegible entries, or for any technical issues that may arise during the entry process. This includes errors, interruptions, defects, delays, theft, unauthorized access to or alterations of entry materials, or inaccurate transmission of entry information. Furthermore, Sponsor cannot be held responsible for any injury or damage to Entrant's or any other person's mobile device that may occur while participating in the Sweepstake.
The Sponsor hereby retains the right to disqualify any individual from any promotion it sponsors, if and when Sponsor believes that the individual has intentionally violated the Official Rules. Furthermore, Sponsor holds the exclusive right to suspend, modify, or terminate the Sweepstake if Sponsor believes that malfunction, error, disruption, or damage is impairing or will impair the administration, security, fairness, integrity, or proper conduct of the Sweepstake.
Any individual who is found to be tampering with the entry process or the operation of the Sweepstake, acting in violation of the Official Rules, acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstake, or to annoy, abuse, threaten or harass any other person, may be disqualified. The Sponsor reserves the right to seek damages and other remedies from any such individual to the fullest extent permitted by law.
